This comment was not addressed. Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

As no plans were submitted Zoning cannot determine if the comments were addressed.

1. COMMENT: Please provide clarification on the intended use, as no kitchen is being proposed clarify. If the structure is intended to be an Accessory Dwelling Unit (ADU), a variance for the structure's height would be required, UDC 6.6.3.D. However, if it is intended as a second unit, no height variance would be required but the unit will be subject to use specific standards “4.9.7.B.1 - .9, & .11”

2.COMMENT: Provide a floor plan of the existing residence, so that Zoning can verify if the requirements of UDC Article 4.9.7.B.7 are applicable to this project.



If the proposed setback is less than a foot a variance will be required.
3. COMMENT: The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Based on a wall height of 25’-0” the required perimeter yard setback from the proposed structure to the west property line is 16’-8”, proposed setback is 0’-8“”. Based on a wall height of 25’-0” the required perimeter yard setback from the proposed structure to the north property line is 16’-8”, the proposed setback is 4’-6“the proposed setback to the 2nd floor deck is 0’5”. If the setback is one foot or greater a Design Development Option (DDO) can be submitted, if the setback is less than one foot a Board of Adjustment for variance is required. The Board of Adjustment is a separate submittal from the building plan and is submitted at: https://www.tucsonaz.gov/pdsd-filedrop, using the Submission Type “Zoning Administration”. 01/10/2024 Zoning Modifications - DDO REQUIRES RESUBMIT Further clarification is needed regarding the proposed use and perimeter yards. A Design Development Option (DDO) may only be processed if the proposal is a two-story dwelling with a setback of at least 1'-0". A Board of Adjustment variance is required to be granted to allow the construction of a two-story, detached accessory structure or a two-story, detached accessory dwelling unit. Additionally, a Board of Adjustment variance is required to be granted to allow a perimeter yard of less than 1'-0". Please also note that compliance with use-specific standard 4.9.7.B.7 shall be demonstrated on the site plan if a second dwelling or sleeping quarters is proposed.

If a DDO is pursued, provide the required and proposed perimeter yards within the narrative. For two-story projects, a narrative describing how the project is in compliance with UDC 3.11.1.D.1.f-.j and 3.11.1.D.2.a-.e is required. Additionally, an aerial photograph showing the locations of other two-story structures in the immediate area shall be submitted.
