Congress St. – R-2 Detached Carport (2nd Review) TRANSMITTAL DATE: February 14, 2024 COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This site is located in the R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, .9, & .10. 1. This comment was not addressed. There is no height dimension or setback dimension provided as described below. The setback waiver was not provided on the plot plan as required below. Provide written documentation that indicates that the person(s) that sign the setback waive are members of the owning LLC. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Where the wall meets the eave of the roof. In the case of carport type structures this distance is measured from design grade to top of beam where rafters sit on beam. Provide this dimension on the plan. Perimeter yard setbacks are measured from the columns supporting the structure, UDC Article 6.4.5.B.2, clearly show the columns on the plot plan and provided a setback dimension from the column to the east property line. It does not appear that the proposed carport will met perimeter yard setbacks. Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ 2. The plans show the carport extending into the neighbors property to the west and this will require at a minimum some type of recorded easement or agreement or a lot line reconfiguration.
