TC-RES-1025-05285 PROJECT: RESIDENTIAL POOL ADDRESS/PARCEL: 2891 W PLACITA DE JUAN Plan review for the above referenced structure has been completed. This letter reflects comments to be addressed. The scope of this plan review covers architectural, plumbing, mechanical, energy conservation and electrical. All code references are to the 2018 International Swimming Pool and Spa Code, 2018 International Residential Code and 2018 International Energy Conservation Code. All features were checked only to the extent allowed by the submittals provided. All portions of this project are assumed to meet or will meet other departmental requirements, conditions and concerns before permit approval. COMMENTS: 1. This permit will need to be voided and re-applied for as a Commercial Swimming Pool & Spa. This is a multifamily dwelling and should be considered as such. An email dated 10.03.2025 to Mark Ragel was explicit about the need for a commercial swimming pool permit. 2. Title 18 of the Arizona Administrative Code defines a Private Residential swimming pool as: “Private residential swimming pool” means a swimming pool at a private residence used only by the owner, members of the owner’s family, and invited guests, or a swimming pool that serves a housing group consisting of no more than three living units [for example, duplexes or triplexes}. – Chapter 5 Department of Environmental Quality. There are four addresses associated with this parcel (1010, 1012, 1014, 1016 S Rubio Av). 3. Per Zoning Comments, a Development Package will need to be submitted. 4. As part of the development package, please show the proposed wall/fence. 5. A separate fence/wall permit will be required. 6. Review by Pima County Heath Department will be required (https://www.pima.gov/2053/Food-Pool-Certification) 7. An aquatic facilities permit will be required from Pima County. A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.6. RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Please correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed. 1. Please submit a Development Plan. Although located in an R-3 zone, the proposed spa is located within what is considered as a commercial use property since there are more than three dwellings. Per UDC Article 3.3.3.G.2., a site plan (Development Package) is required for the following types of development: b. “All residential development with three or more dwelling units on one lot.” And c., “Existing development undergoing a change of use, building structure additions, and/or a reconfiguration of an area outside a building.” A Development Package (DP) meeting the requirements of the Checklist for Minor Changes to Commercial/Industrial Sites is required to be submitted and approved. The DP is a separate submittal from the building plans.
