| 11/05/2025 | Residential Zoning | REQUIRES RESUBMIT | FROM: PDSD Zoning Review Section PROJECT: TC-RES-1025-05181 9422 E 5TH ST. – HR-3 EXTERNAL REMODEL ON EXISTING STRUCTURES, NEW EXTERIOR TERRACES AND A NEW CABANA AND GARAGE (1st Review) TRANSMITTAL DATE: November 5, 2025 COMMENTS: Provide a detailed response letter with your submittal that clearly shows how you have addressed all Zoning comments. 1. This site is located in the HR-3 zone (UDC 4.7.9). A duplex is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6. 2. The lot coverage calculation is not correct. Review UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Building-Safety/Plan-Examples/Plot-Plan-Example. 3. The ‘SETBACH REQUIREMENTS” “10’ OR ¾ OF BUILDING HEIGHT” is not correct. Review UDC Table 6.3-2.A and provide the correct setback requirements for a residential use to a residential zone. 4. Provide perimeter yard setbacks from all proposed structures to the applicable property lines, i.e. proposed kitchen terrace to the south property line, proposed cabana & garage to the north property line. 5. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Provide wall heights from design grade for all proposed structures. COMMENTS: the following comments are relative to an application for Historic Review (UDC 5.8.8). As all required perimeter yard setbacks were not provided additional comments maybe forth coming. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). 1. It does not appear that the proposed cabana & garage and kitchen terrace meet the minimum 6’ setbacks to the north and south property lines. The minimum setback to a side street property line is ten (10) feet (UDC Section 6.4.5.C.1.b). 2. The proposed cabana & garage proposed setback to the Railroad Ave property line is 0’-0”. Historic may waive required perimeter yard setbacks but if not waive a Design Development Option (DDO) will need to be submitted and approved.
