Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the R-1 zone (UDC 4.7.1). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 10.

1. Clarify the number of bedrooms in the existing dwelling, provide a full floor plan for the existing dwelling. Per use-specific standard 4.9.7.B.7, for any new single-family dwelling in the R-1 zone with five bedrooms, three parking spaces are required. For every bedroom over five, one additional space is required for each bedroom. For all single-family dwellings in the R-1 zone with five or more bedrooms, all parking spaces must be located on-site, either in a side or rear perimeter yard. Parking spaces may not be located in a vehicular use area in any front street perimeter yard. A parking area is not required to be developed to a commercial standard. A dustproof parking surface is required to at least a minimum of two inches of compacted pea gravel. An existing covered residential parking area may be used. Per UDC 11.4.3, the term bedroom includes all of the following: 1) Any room that is designated as a bedroom; 2) Any enclosed room that has a minimum area of 60 square feet and has an accessible opening to the exterior of the building in compliance with the International Building Code (IBC), whether termed a studio, family room, study, den, bonus room, or any other name, except for a living room, dining room, kitchen, and bathrooms; and 3) Any room designated as a bedroom for the purpose of any other code requirement.

2. The “SIDE (SOUTH)” setback listed is not correct. Review UDC Article 6.4.5.C.1 and provide the correct setback.

3. The lot coverage calculation is not correct. Per UDC Article 6.4.3.C.1.a Roofed areas, porches, open on at least one side are not included in the calculation.

4. Per UDC Article 6.6.3.E The total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure. Based on the square footages provided the existing detached garage, shed and proposed sleeping quarters exceed the allowed 50%. A Board of Adjustment for Variance must be submitted and approved. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration. Contact for the Board of Adjustment is Mark Castro at Mark.Castro@tucsonaz.gov.

5. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Based on a wall height of 12’-8” to design grade the required perimeter yard setback to the north property line is 8.45’, proposed is 4.00’ and based on a wall height of 9’-10” to design grade the required perimeter yard setback to the east property line is 6.56’, proposed is 5.00’. At a minimum, a neighbors setback waive is required to reduce the perimeter yard setbacks. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.

Signature: _____________________________

Date: _________________________________
If you are unable to secure the required waiver a Design Development Option will need to be submitted and approved. DDO application and requirements can be found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration. If you have questions about the DDO application or process please contact Georgia Pennington at Georgia.Pennington@tucsonaz.gov”.

6. Based on aerial photographs there are what appears to 3 water cisterns and some type of shade structure along the south side of the existing dwelling. Zoning was not able to find approved permit/compliance review documents for these structures. These structures will need to be shown on the plan along with there size and heights so that development standard requirements can be determined.
