Fire separation:
1. Show that the Gravel Driveway is a registered access easement or provide 3-foot fire separation from the property line.
2. Any structure placed within the 3-foot fire separation distance, from the neighboring property line, requires not less than one-hour fire-resistive construction for reducing fire spread across the line, R302.1(City of Tucson Amended). Fire rated materials are found in IBC Table 721.1(2), Items 15-1.1 to 16-1.3.
3. Roof projections extending into the 3-foot fire separation distance require not less than one-hour fire-resistive construction on the underside, R302.1 (City of Tucson Amended). The fire protected overhang may not extend closer than 24” from the line used to determine the fire separation distance.

TRANSMITTAL DATE: November 7, 2024

This site is zoned MH-1 (UDC Section 4.7.10). A detached single-family dwelling is a permitted use in the MH-1 zone. Solar energy collectors are permitted as an accessory use.

1. (Comment) Provide setback distances for the new canopy on the site plan. Setback should be measured from the outside face of the canopy post to the nearest property lines. Per the site plan, the canopy appears to be detached. It also appears to be within the required 6’ or 2/3 of wall height (whichever is greater) setback distance.

Per UDC Section 6.6.2., “An accessory structure , except for an accessory dwelling unit , that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure , except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s)”

On resubmittal, provide a copy of the signed neighbor waiver language on the site plan. The waiver language follows:

“My name is ______ and I am the owner of the property located at ______. I have reviewed the site plan and I have no objection to the structure being located or construct __ feet from the property line as depicted on the site plan.

Date: _________”

If the neighbor refuses to sign, then a Design Development Option (DDO) would be required to be approved to allow the reduced setback for the canopy. 2. (Comment) Per UDC 6.6.3.D, a detached accessory structure – such as this canopy – is only permitted to be a height of 12’ as measured from design grade. The site plan shows 12’ 11” ½.

A variance granted by the Board of Adjustment would be required for a height above 12’. You can also reach out to Mark Castro at the contact information provided in comment 1 above about the Board of Adjustment process and requirements.
