This comment was not addressed. Provided a detail comment response letter with your submittal that clearly shows how you have addressed all comments with your next submittal.

This site is located in the RX-2 zone (UDC 4.7.7). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-1).

1. Provide a residential plot plan that clearly shows the location of the proposed fence. The plot plan shall meet the requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Building-Safety/Plan-Examples/Plot-Plan-Example.

2. There is a 7.5’ utility easement that runs along the west property line. Show this easement on the plot plan and if you are proposing to place the proposed fence within this easement written permission to locate the fence within the easement from all utilities that have rights to the easement will be required

3. Per the Unified Development Code (UDC), found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Codes-and-Plans/Zoning-Code, Article 6.6.2.I The maximum height of a wall or fence within a perimeter yard shall be six feet; however, the wall or fence may be higher than six feet, but no higher than ten feet, if: (See Figure 6.6.1-A, Height of Wall or Fence within a Side or Rear Perimeter Yard .)
1. At least 75% of the area above six feet in height is left unobstructed and open through the use of architectural elements, such as arches, columns, or wrought iron;
2. Part of, or located on top of, a retaining wall no higher than ten feet measured from design grade and no higher than six feet measured from the top of the retaining portion of the wall;
3. A greater height is required through the rezoning process or the special exception land use process; or,
4. A greater height is required by a specific UDC standard.
That said the proposed 7’-0” high fence either needs to meet the required minimum 20’-0” perimeter setback (UDC Table 6.3-1), meet one of the 4 exceptions listed above, or a Design Development Option (DDO) must be submitted and approve for the 7’-0” height.


4. There is some type of shade structure attached to the southwest end of the residence and a shed near the northeast corner of the residence that show up on aerial photos sometime after 2016. Zoning was not able to find approved permit or compliance documents for these structures. Provide approved documents with the next submittal or include them in this permit. The shed does not appear to meet the required perimeter yard setback. At a minimum a neighbor’s setback waiver is required. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
