The site is in the R-1 zone (UDC 4.7.8). An accessory dwelling unit is a permitted use in the R-1 zone, subject to use-specific standards 4.9.7.B.6, .8, .9, and 6.6.3. A single-family dwelling is also a permitted use in the R-1 zone, subject to use-specific standards 4.9.7.B.5-.9.

COMMENTS:

1. The property is subject to the Approach Department Corridors (ADC) for Davis Monthan Air Force Base (UDC 5.6.8). Per UDC 5.6.8.A.3.d(2), residential development is limited to no more than one dwelling unit per acre in ADC-1. As such, an accessory dwelling unit is not permitted at this location and must be submitted as a sleeping quarters limited to a wet bar sink and under-the-counter refrigerator. Subsequent comments will apply if a sleeping quarters is proposed.

2. Based on the floor plan provided, five total bedrooms are proposed on the site. Demonstrate compliance with use-specific standard 4.9.7.B.7 by showing the third required motor vehicle parking space in a side or rear yard. The parking space cannot be located within the front street perimeter yard and must consist of a dustproof parking surface to at least a minimum of two inches of compacted pea gravel.

3. Perimeter yards are based on a measurement from the design grade elevation to the highest point of the exterior building wall (see UDC 6.4.5.B and Figure 6.4.5-A). Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required perimeter yard is six feet or 2/3 the height of the exterior building wall, whichever is greater.

Based on a wall height of 11’-10”, the required side perimeter yard is approximately 7’-11”. The proposed side perimeter yard is 3’-0” as measured from the west lot line.

Based on a wall height of 11’-10”, the require rear perimeter yard is approximately 7’-11”. The proposed rear perimeter yard is 5’-0” as measured from the south lot line.

Neighbor’s setback waivers in accordance with UDC 6.6.2.D can be utilized to reduce the side and rear perimeter yards for a detached sleeping quarters. The waivers shall be signed by the owners of 2930 East 23rd Street, 2925 East 24th Street, and 2935 East 24th Street. The signed waivers shall be pasted directly onto the site plan with the following language:

If all three signed neighbor’s setback waivers cannot be obtained, a process such as a Design Development Option (DDO) or Board of Adjustment variance is required to reduce the perimeter yard(s). Contact Mark.Castro@tucsonaz.gov if you have questions about the DDO or variance processes.

4. Per UDC 6.6.3.E, the total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure. Accessory structures less than 200 square feet gfa and accessory dwelling units are exempt from this requirement.

A Board of Adjustment variance is required to be granted to allow the sleeping quarters and existing workshop to exceed 50% of the gfa of the existing dwelling. Per a previous Zoning Administrator’s determination dated December 1, 2008, an accessory structure may be considered structurally attached to the principal building if a five-foot-wide connection that supports a live load of 20 pounds or more connects the two structures.
