PROJECT: TC-RES-0823-07674
826 East 31st Street – R-2
ADU (1st Review)

TRANSMITTAL DATE: September 11, 2023

Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

1. Per Tucson Unified Development Code (UDC) Section 6.4.3.C.1.a, roofed areas, open on at least one side, which provide shelter to exterior areas and are not used for utilities, maintenance, laundry, storage, or motor vehicle parking, are not included in the lot coverage calculation.

Remove the porches and covered entry from the lot coverage calculation.

2. Per UDC Section 6.6.3.B.5, for lots equal to or greater than 6,500 square feet, the accessory dwelling unit is limited to 10% of the lot size.

Based on available Pima County Assessor’s Office information, the size of the lot is 7,500 square feet. A Board of Adjustment variance is required to be granted to allow the proposed ADU to exceed this requirement.

3. The existing porch, attached to the residence, appears in aerial photography beginning in 2019. The Zoning Review Section concluded that a building permit was not obtained for this porch. A separate building permit is required to be obtained to allow this porch to remain.

4. An attached porch depicted as a “lattice” appears in aerial photography beginning in 2021. The Zoning Review Section was unable to determine whether this porch was permitted. The porch appears to maintain a zero-foot setback and requires a Board of Adjustment variance to be granted to allow this porch to remain. Contact Mark.Castro@tucsonaz.gov should you have questions about the variance process.

5. A perimeter wall appears in aerial photography beginning in 2021. The Zoning Review Section concluded that a zoning compliance review was not conducted for this wall. Provide the height and location of the perimeter wall on the site plan. Per UDC 6.6.2.I, the maximum height of a wall or fence within a perimeter yard shall not exceed six feet.

Comments 3, 4, and 5 can be submitted under the same building permit application under application type “Residential Addition/Alteration Permit.”

If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951.
