COMMENT: Provide a detail comment response letter with your submittal that clearly shows how you have addressed all comments with your next submittal.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Where the wall meets the eave of the roof. As wall height dimensions were not provided from design grade Zoning has added 6” to the heights provided on sheet A3.01 to determine perimeter yard setback requirements.

The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).

1. Based on a wall height of 12’-6” the required perimeter yard setback from the proposed Garage and Workshop to the north property line is 8’-4”, proposed setback is 6’-0”.

2. Based on a wall height of 17’-6” the required perimeter yard setback from the proposed Garage and Workshop to the east property line is 11’-8”, proposed setback is 10’-0”.

For comments 1 & 2 at a minimum a neighbors setback waiver will be required to reduce the required perimeter yard setbacks. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):

If you are not able to secure the setback waive the request to reduce the setbacks can be included in the required Variance process below.

3. Per UDC Article 6.6.3.E The total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure . Accessory structures less than 200 square feet gfa and accessory dwelling units are exempt from this requirement. The proposed Garage and Workshop exceeds the allowed 50%. A Board of Adjustment for Variance will need to be submitted and approved.

4. Per UDC Article 6.6.3.D Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. Per UDC Article 6.4.5.A Measurement of Building Height, building height is the vertical distance measured from the design grade elevation to the highest point of a flat roof; to the deck line of a mansard roof; or to the middle (between the eave and ridge ) of the highest gable of a pitched or hipped roof. Provide a dimension from design grade to the midpoint of roof on the building elevations, see figure 6.4.4-A. As building height dimensions from design grade were not provided Zoning cannot determine if the proposed Garage and Workshop exceeds the allowed height. If the allowed 12’ height is exceeded a Board of Adjustment for Variance will need to be submitted and approved.

5. Per UDC Article 6.6.4.C.5 Parapet walls and safety railings may not exceed the allowed 12’ by more than 4’-0”. The proposed 5’-0” parapet exceeds the allowed 4’-0”. Board of Adjustment for Variance will need to be submitted and approved.
