08/15/2025 Site Zoning REQUIRES RESUBMIT PDSD TRANSMITTAL

FROM: Jeffrey W. Cassidy, Planner
Planning & Development Services Department – Current Zoning Review Section

PROJECT: TC-RES-0625-03035 – Residential – Approximately 160’ linear feet of 6’ tall corrugated fencing.
2105 E Blacklidge Dr, Tucson AZ 85719 (R-1 Zoning)
Site Plan Review – 3rd Review

TRANSMITTAL DATE: August 15, 2025

This site is in the R-1 Residence Zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9 for 1 unit; 4.9.7.B.1 - .9, & .11 for 2 units (min. 10,000 sq ft lot size required).

Plan review for the above referenced corrugated fencing has been completed. This letter reflects comments to be addressed. For facilitating a shorter back check time, please provide updated plans and calculations with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment updates; revisions are processed if changes occur after the permit is issued.

SCOPE OF REVIEW:
The scope of this plan review covers zoning, use(s), legal description, adjacent properties, setbacks (building or wall heights), dimensional standards, property permitting history, density (units/lot size), and lot calculation (enclosed building and structure, parking, and driveway versus overall lot size) requirements. All code references are to the Tucson, AZ Unified Development Code. All features were checked only to the extent allowed by the submittals provided. All portions of this project are assumed to meet or will meet other departmental requirements, conditions, and concerns before permit approval.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED:
Correct the following plot (site) plan sheet and fence elevation sheet, as noted in the comments below, along with a DETAILED RESPONSE LETTER indicating responses to the review comments.

PLANS:

1. COMMENT: The site plan provided is incomplete.

a) Provide a site plan that meets the requirements show in the plot plan example at the following link:

https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example

b) Per the plot plan example:

1) Draw, label and dimension every structure on-site (permitted and unpermitted*) to a scalable drawing graphic. Additionally, provide dimensions of any structure as it relates to nearby structures and property lines. *Depending on what this structure is and its size, this may or may not be added to this permit. Email zoning reviewer (below) for clarification prior to submitting for subsequent submittal.

2) To complete missing information on the plot plan example refer toPima County’s website https://gis.pima.gov/maps/detail.cfm?&parcel=112050870

3) Update site plan to be reflective of information on Pima County’s website. For example, the 309’ does not match the 293.09’ dimension and the property is a rectangle as opposed to what is currently depicted. See https://www.asr.pima.gov/ParcelData/Map/Arm/MP06/06049_03.pdf

4) Measure square footage of every structure (utility shed) on site and driveway/vehicular use area and input into lot coverage calculation table.

5) Provide density calculations information from plot plan example provided.

6) Update the primary residence graphic to be representative of reality via Pima County’s website https://www.asr.pima.gov/ParcelData/prc/11205/0870.pdf.

2. COMMENT: *After reviewing the property documentation history in PRO, zoning could not verify any permit documentation for the existing utility shed.

Zoning will not be able to approve the permit application until the permit information is provided. If permit documentation cannot be provided and depending on its size, the utility shed may or may not be included as a part of this permit application or applied for and issued under a different permit. Coordinate with Zoning reviewer prior to the next submittal to determine if this can be included or will require an additional permit at Jeffrey.cassidy@tucsonaz.gov

Additionally, depending on the height and/or how close it was located to the property line(s), this structure was potentially located in the north, east, west and south setback(s). A neighbor sign off would be required. The adjacent owner’s () waiver statement(s) must be added to the site plan. The following statement can be used.

3. COMMENT: Per TABLE 6.3-2.A of the UDC (referenced below), the perimeter yard setback(s) along the north, east, west and south property line(s) are 6’ or 2/3 the height of the utility shed, WHICHEVER IS GREATER. Depending on how far the utility shed sits off the west property line, three options exist:

a) 1’-0” or more (but still encroaching in setback) or Less than 1’-0”: Secure a neighbor setback waiver (provided below) signed and dated by the property owner(s) to the north, east, west and south (across the street / alley):

(Neighbor Waiver Sample – Copy and Paste, exactly as shown, onto Site Plan):

My Name is __________________ and I am the owner of the property located at
________________________. I have reviewed the site plan and I have no objection to structure being located or constructed ______ feet from the property line as depicted on the site plan.

Signature: _______________________ Date:___________________________

Mi hombre es ________________ y yo soy el dueño de la propiedad ubicada en la
_____________________. He revisado el plan y no tengo ninguna objeción a que
estructura se encuentra o construye ____________ desde la línea de propiedad,
como se muestra en el plan.
Firma: _________________________Fecha: ________________________________

b) 1’-0” or more: Should you be unsuccessful in your attempt to retrieve the neighbor waiver there is a Design Development Option (or DDO) affords an attempt to seek relief from the setback requirements. This information is linked here:

https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration#section-3

To submit a DDO application, apply for a new sub-record under this permit at TDC Online.

https://www.tucsonaz.gov/files/sharedassets/public/v/2/pdsd/documents/tdc-faq/new-pdfs/sub-records.pdf

See below for more information on the DDO process.

c) Less than 1’-0”: Should you be unsuccessful in your attempt to retrieve the neighbor waiver, a board of adjustment variance will be required to permit the utility shed as shown on the site. See variance requirements below. Zoning cannot approve this permit until the Board of Adjustment (B/A) Variance Process is completed and approved.

See below for more information on the B/A Variance process.

Prior to doing this and in hopes to avoid this step, a records request is recommended to determine if the history of this garage being located within the setback can be verified and thus, potentially avoiding the need to seek a Board of Adjustment Variance. Should you be successful in retrieving any permit information from the archives, upload these documents in pdf format as part of the next review cycle.

4. COMMENT: Provide height of utility shed. Per UDC Article 6.6.3.D Accessory structures (utility shed), except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted shall be the same as for the principal structure. A Board of Adjustment for Variance will be required to permit the utility shed if it exceeds 12’-0”. See variance requirements below.

If a Board of Adjustment Variance is required, zoning cannot approve this permit until the Board of Adjustment (B/A) Variance Process is completed and approved.

See below for more information on the B/A Variance process.

5. COMMENT: As currently shown in the fence elevation drawing the proposed fence is 6’-6” from finish grade. Per 6.6.2.I (UDC), “The maximum height of a wall or fence within a perimeter yard shall be six feet; however, the wall or fence may be higher than six feet, but no higher than ten feet, if: (See Figure 6.6.1-A, Height of Wall or Fence within a Side or Rear Perimeter Yard.) “.

Update elevation drawing to reflect compliance with 6’-0” overall dimension from FINISH GRADE and label the finish grade, 6” open gap and 5’-6” fence height to reflect a total heigh of 6’-0”. A Design Development Option (or DDO) affords an attempt to seek relief from the height requirements. This information is linked here:

See below for more information on the DDO process.
