| 07/17/2024 | Site Zoning | REQUIRES RESUBMIT | ZONING REVIEW TRANSMITTAL FROM: Wyatt Berger Lead Planner PROJECT: TC-RES-0624-03855 2721 North Avenida Empalme – RX-2 Garage (1st Review) TRANSMITTAL DATE: July 17, 2024 The following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1). 1. Per Tucson Unified Development Code (UDC) Table 6.3-1.A, when a residential use is adjacent to a residential zone, the required perimeter yard is twenty feet. Where an unbroken section of a wall or building is not parallel with the lot line, the required perimeter yard may be applied to the average width; however, such perimeter yard shall not be narrower at any point than half the required width, nor narrower at any point than three feet (UDC 6.4.5.B.5 and Figure 6.4.5-A). Indicate the average width of the perimeter yards as measured from the north and west lot lines to the proposed garage. The side perimeter yard may be reduced with a neighbor setback waiver in accordance with UDC 6.6.2.D. The setback waiver shall be signed by the owners of 2731 North Avenida Empalme and pasted on the site plan with the following language: My name is ________ and I am the owner of property located at ________. I have reviewed the site plan and have no objection to the structure being constructed __ feet from the property line as depicted on the site plan. Signature: ________ Date: _________ 2. As the rear alley is greater than twenty feet in width, a neighbor setback waiver cannot be used to reduce the required rear perimeter yard as measured from the west lot line. As such, a Design Development Option (DDO) is required to reduce the rear perimeter yard to less than twenty feet. The DDO application and requirements can be found at: https://www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/planning-amp-zoning/ddo_for_setback_and_height_udc.pdf. Zoning cannot approve TC-RES-0624-03855 until the DDO process has been completed. Contact Georgia.Pennington@tucsonaz.gov or Mark.Castro@tucsonaz.gov if you have questions about the DDO process. 3. The “existing walls and gates” as depicted on the site plan appear in aerial imagery in 2019. A zoning compliance review was not obtained for this perimeter wall. Provide the height of the perimeter wall to demonstrate compliance with UDC 6.6.2.I relating to the maximum height of a perimeter wall. If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951. RESUBMITTAL OF THE FOLLOWING IS REQUIRED: A revised plan set as well as a comment response letter. To resubmit, visit the Tucson Development Center Online at https://tdc-online.tucsonaz.gov/#/home.
