| 09/11/2023 | Site Zoning | REQUIRES RESUBMIT | ZONING REVIEW TRANSMITTAL FROM: Wyatt Berger Lead Planner PROJECT: TC-RES-0623-05950 1921 West Merlin Road – R-1 Patio and carport additions (2nd Review) TRANSMITTAL DATE: September 11, 2023 Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed. 1. This comment was not addressed. Per Tucson Unified Development Code (UDC) Section 6.4.3.C.1.a, roofed areas, open on at least one side, which provide shelter to exterior areas and are not used for utilities, maintenance, laundry, storage, or motor vehicle parking, are not included in the lot coverage calculation. Remove the existing porch and proposed patio from the lot coverage calculation. 2. Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required setback is six feet or 2/3 the height of the posts of the carport and patio, whichever is greater, measured from the property line. Based on a wall height under 9’-0”, the required setback as measured from the east property line is 6’-0”; the proposed setback is eleven and one-eighth inches based on the drawings provided in the DDO application. A DDO may only be utilized to reduce a setback to as little as one foot from the property line. A Board of Adjustment variance is required to be granted to allow this specific setback reduction. Contact Mark.Castro@tucsonaz.gov should you have questions about the variance process. If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951. |
