Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

The following comments are relative to an application for a Board of Adjustment variance (UDC 3.10.3).

The site is in the R-2 zone (UDC 4.7.9). A duplex is permitted in the R-2 zone, subject to use-specific standards 4.9.7.B.6, .9, and .10.

1. Per UDC 6.4.3.C.1.a, roofed areas, open on at least one, such as porches, are excluded from lot coverage. Remove the proposed front and rear porches from the lot coverage calculation.

2. Per UDC 6.4.5.C.1.b, where a lot abuts more than one street, the owner chooses which street lot line is the front lot line. From other than the front lot line, the street perimeter yard is ten feet, as measured from the street lot line.

The minimum required side street setback measured from the west lot line is 10’-0”; the proposed side street setback is 7’-0”. Stone Avenue is an arterial road identified in the Major Streets and Routes Plan Map. While a Design Development Option (DDO) allows for setback modifications, a DDO cannot be utilized to modify a requirement of an overlay zone such as the Major Streets and Routes Setback overlay zone (UDC 3.11.1.D.1.d).

As such, a Board of Adjustment variance is required to be granted to reduce the side street perimeter yard setback. Contact Mark.Castro@tucsonaz.gov should you have questions regarding the Board of Adjustment variance process.
