Provide a detailed response letter with your next submittal that clearly shows how you have addressed all Zoning comments.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

To clarify requirements for building permits. Any structure greater than 200 sq. ft. requires a building permit. Structures 200 sq. ft. or less required Zoning Compliance review. The 760 sq. ft. shade structure requires a building permit and shall meet all zoning requirements and can be included in this permit as long as you provide the applicable building plans. The other two (2) shade structures do not require building permits but are required to meet zoning requirements, i.e. perimeter yard setbacks, maximum height requirements 12’, etc. As building review is required for the 760 sq. ft, shade structure Residential Review will be added back into the review. 1. Provide a residential plot plan that meets the requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example. The plot plan shall show all structures that are located on site along with all required information.
a. The plot plan shall be drawn at an engineering scale, i.e. 1” = 10’, 1” =20’.
b. Provide the property dimensions on the plot plan.
c. It does not appear that the street dimensions provided are correct. Review Construction Plan I-481, sheet 6, found at: https://maps-and-records.tucsonaz.gov/construction-plans/details/I-481, and provide a dimension from centerline of both streets to the face of curb, and from the face of curb to the applicable property line. Dimensions from the centerline of streets to structures are not required.
d. Provide perimeter yard setback dimensions from all proposed and existing structures to the applicable property lines. For porch and shade type structures the perimeter yard setbacks are measured from the post supporting the structure as long as the roof overhang is not more than 2’-0”, UDC Articles 6.4.5.B.2, 6.4.5.D.1.b & 6.4.5.D.2.a.(2).
e. Provide the height of the existing structures to be permitted. Height measurements for a shade type structure is measured from design grade to top of beam supporting the roof, UDC Article 6.4.4.A.

2. Based on aerial photos there are numerous structures located in the rear yard area that show up sometime after 2005. Zoning was not able to find approved permit/compliance documents for these structures. Either provide copies of the approved permit documents of include them in this permit. Zoning acknowledges that some of the structures have been removed from site. Either provide photos that clearly show that the structures have been removed or show the structures on this plot plan as to be removed.

3. The following are perimeter yard setback requirements for the proposed porch and existing structures to be permitted:
Street Perimeter Yard Setbacks (East Property Line) – Per UDC Article 6.4.5.C.1.b where a lot abuts more than one street, the owner chooses which street lot line is the front lot line. From other than the front lot line, the street perimeter yard is ten feet, as measured from the street property line.
Interior Perimeter Yard Setbacks (North & West Property Line) – Per UDC Table 6.3-2.A, R-1 Zone, Residential Use to a Residential Zone the required perimeter setback is 6’-0” or 2/3 (H), (H) = Height of the proposed exterior building wall, greater of the two dimensions apply.

4. If the proposed porch and 760 sq. ft, unpermitted, shade structure do not meet the minimum 10’-0” perimeter yard setback to the east property a Design Development Option (DDO) must be submitted and approved to reduce the required east setback. DDO application and requirements can be found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration. 5. If the three (3) unpermitted shade structures do not meet interior perimeter yard setbacks to the north and west property line a neighbors setback waive may be used to reduce the setback, UDC Article 6.6.2.D. ). To secure this neighbor’s setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
