The site is in the R-1 zone (UDC 4.7.8). A single-family dwelling is a permitted use in the R-1 zone, subject to use-specific standards 4.9.7.B.5-.9.

COMMENTS:

1. Indicate on the site plan that the ADU is being reviewed and permitted under TC-RES-0624-03329. Remove the ADU floor plan from the construction drawings as well.

2. Provide a dimension from the centerlines of both streets to the faces of curb (where the pavement meets the concrete curb), as well as from the faces of curb to the street property lines.

The distance from the centerline of 3rd Street to the face of curb is 19.6’ and from the face of curb to the street property line is 20’.

The distance from the centerline of Bentley Avenue to the face of curb is 18’ and from the face of curb to the street property line is 12’.

3. Perimeter yards are based on a measurement from the design grade elevation to the highest point of the exterior building wall (see UDC 6.4.5.B and Figure 6.4.5-A). Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required perimeter yard is six feet or 2/3 the height of the exterior building wall, whichever is greater.

Based on a wall height of 10’-10”, the required side perimeter yard is approximately 7’-3”. The proposed side perimeter yard is 6’-0” as measured from the east lot line to the carport.

Based on a wall height of 9’-10”, the required side perimeter yard is approximately 6’-7”. The proposed side perimeter yard is 6’-0” as measured from the east lot line to the laundry room.

A Design Development Option (DDO) is required to reduce the above setback requirements. 4. Per UDC 6.4.5.C.1.b, from the other than the front lot line, the street perimeter yard is ten feet as measured from the street property line. For carports and garages which face the street, the minimum required street perimeter yard is 20 feet regardless of the street. The proposed side street perimeter yard is 1’-0” as measured from the west lot line to the garage door.

A DDO cannot be utilized to reduce a structural setback for a garage to less than 18 feet in width. As such, a Board of Adjustment variance is required to be granted to allow the setback to be reduced to 1’-0”.
