This site is located in the R-1 zone (UDC 4.7.8).
1. (Comment) Per UDC Section 6.3-2.A, the required setback in the R-1 zone is the greater of 6 feet or 2/3 the height of the proposed building wall.
a. With a proposed living room wall height of 11’ 5”, the required eastern side yard setback is 7’ 9”. The proposed setback is 7’ 3”; as such, a Design Development Option (DDO) must be applied for and approved in order to reduce the setbacks as proposed before this permit can be approved by Zoning.

b. With a proposed carport wall height of 8’ 8”, the required side yard setback is 6’. The proposed setback is zero; as such, a Design Development Option (DDO) must be applied for and approved in order to reduce the setbacks as proposed before this permit can be approved by Zoning.

2. (Comment) Per UDC Section 6.4.5.B.2, setback distances for an attached carport are measured from property line to the front of the carport’s posts or columns. On next submittal, please indicate the distances from the both the carport’s roof overhang and its posts to the property line. Please also provide post/column height on elevations on next submittal.

3. (Comment) Per UDC Section 3.11.1.D.1.e, an approved DDO exemption can reduce minimum side setback distances, but only to 1’, not zero. A zero-foot setback would require a Board of Adjustment Variance.

4. (Comment) In order to proceed with this addition, the applicant will need to undergo the Design Development Ordinance (DDO) Process to request the reduced side setbacks as shown on the proposed plans. A DDO application can be found at https://www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/planning-amp-zoning/ddo_for_setback_and_height_udc.pdf. If you have questions about the DDO (or Board of Adjustment Variance) application or process please contact Mark Castro at mark.castro@tucsonaz.gov. Approval for permits will not occur until, and if, the DDO is first approved.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: DDO application. Future plans should label distance from both carport posts and overhangs to property lines.
