The following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1). The site is in the R-1 zone (UDC 4.7.8). An accessory dwelling unit is permitted in the R-1 zone, subject to use-specific standards 4.9.7.B.6, .8 & .9, and 6.6.3. 1. Per Tucson Unified Development Code (UDC) Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required perimeter yard setback is 6’-0” or 2/3 the height of the proposed wall, whichever is greater, measured from the lot line. Based on a wall height of 10’-0”, the required setback as measured from the north lot line is 6’-8”; proposed setback is 6’-0”. UDC 6.6.2.D explicitly excludes accessory dwelling units from the neighbor’s setback waiver process. Design Development Option (DDO) approval is required for this setback reduction. The required motor vehicle parking space for the proposed accessory dwelling unit can be waived if the site is within ¼ mile walking distance of a transit stop or an enhanced Bike Boulevard Master Plan (UDC 6.6.3.B.2). Demonstrate compliance with UDC 6.6.2.B.2 if this section of the code is to be utilized.
