COMMENTS:
1. Unfortunately steel structures require an engineered design to be permitted. If this was a prefab structure you may either provide the original drawings with engineer’s stamp, or you will need to have an engineer perform an analysis of the structure and submit that with their stamp/sign off.
2. Structures within 3 feet of the property line require a 1 hour fire rated wall assembly, so you would need to show compliance with that for the Eastern wall of the structure. (R302.1 amended).
3. Please correct and resubmit.

This site is located within the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed.

1. Although a site plan was submitted, it is lined and is insufficient for zoning staff review. Submit a site/plot plan. The requirements for a site plan may be found here: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Site-Plan-Examples . A Full site plan is required.

2. The height of the as-built garage is 14’ which exceeds the 12’ maximum height requirement for detached accessory structures per UDC 6.6.3.D. which states that the maximum height of an accessory structure (other than an accessory dwelling unit) is 12’ unless attached to the principal structure.

3. If the garage is to remain unattached to the residence, a 2’ height variance approved by the Board of Adjustment from UDC 6.6.3.D. is required.

4. Additionally, because the garage also sits within the 5’ setback requirement per UDC Table 6.3-1.A., a request to encroach the 5’ setback by up to 4’ should also be included in the variance application. In other words, request two variances within the same application: a 2’ height variance from UDC 6.6.3.D. and another variance from UDC Table 6.3-1.A. to exceed the required setback allowance by 4’.

To apply for a Board of Adjustment Variance, please submit an application using www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration#section-2 , requesting that the height of the garage be 2’ over the maximum 12’ allowable height. For further information on the Board of Adjustment Variance process, please contact Mark Castro at mark.castro@tucsonaz.gov The updated site plan will be helpful to the Board of Adjustment.

If seeking both variances, until these have been approved and the appeal period has expired, please do not resubmit the package because Site Zoning will not be able to approve the permit. Please include the Board of Adjustment Variance approval notice with the package.

5. If the garage is to be attached to the principal structure (residence), a Design Development Option (DDO) will be required to mitigate the east setback encroachment of 4’. To apply for a DDO, please submit a DDO application under the Zoning Modification sub-record that has been created. For instructions on how to apply for a sub-record, visit the following link:
