| 04/24/2026 | Residential Zoning | REQUIRES RESUBMIT | PDSD TRANSMITTAL FROM: Jeffrey W. Cassidy, Planner Planning & Development Services Department – Current Zoning Review Section PROJECT: TC-RES-0426-01782 – Residential Building – Owner adding livable room to our existing house 142 N MONTEGO DR TUCSON, AZ 85710 (R-1 Zoning) Plan Review – 1st Review TRANSMITTAL DATE: April 24, 2026 This site is in the R-1 Residence Zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9 for 1 unit; The City's Unified Development Code (UDC) (Section 1.4.1.C) establishes that before the City issues any approvals or permits; we must confirm that a site complies with UDC standards. Therefore, as part of permit reviews, we review a site's permit history and compare it to aerial photography to confirm that unpermitted work has not occurred. In many cases, this does mean that a homeowner must apply for permits for unpermitted work before we can approve any new work on that site. Plan review for the above referenced livable room has been completed. This letter reflects comments to be addressed. For facilitating a shorter back check time, please provide updated plans and calculations with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment updates; revisions are processed if changes occur after the permit is issued. 1. COMMENT: The site plan provided is incomplete. Provide a site plan that meets the requirements show in the plot plan example at the following link: https://www.tucsonaz.gov/files/sharedassets/public/v/2/pdsd/documents/plan-samples/basic-site-plan_feb2026.pdf Specifically: A. Draw, label and dimension everything that exists on the property to a scalable drawing graphic (examples include the principal residence, porches, breezeways, sidewalks, driveways, parking spots, walls, fences, ramada, shed, carport, shade sail, cistern, pool, guest house, sleeping quarters, accessory dwelling unit) and provide dimensions of any structure as it relates to nearby structures and property lines and provide the heights (measured from above finish grade to top of wall, etc.) of those structures that run parallel-perpendicular to any nearby adjacent property lines. Provide heights at various locations along the fence/wall if applicable. 1) Draw, label and dimension required two parking spaces. Refer to comment # 2 (below). 2) Draw, label and dimension unpermitted accessory structure and shade sail, both north of residence and provide dimensions of distance between those structures and the adjacent property north line. Provide height of structure and refer to comment 4 below. 3) Draw, label and dimension the two accessory structures along the east property line and provide dimensions of distance between those structures and the adjacent east property line. 4) Draw, label and dimension wall structure in the backyard. B. Provide missing legal description: KINGSTON KNOLLS TERRACE LOT 23. C. The west property line location and associated context (sidewalk, landscape on both sides of sidewalk) are not drawn accurately. Refer to the paving plan https://maps-and-records.tucsonaz.gov/construction-plans/details/I-736 page 018. This is vital as you locate where the west property line is located and read further comments regarding the 20’-0” front yard setback (Comment #3 below) from that west property line. Currently, the drafter is incorrectly depicting the property line at the street. D. Provide dimension from centerline of N Montego Dr to curb. E. Provide dimension from curb to property line. F. Draw and label front N Montego Dr and 17’-0” wide alley (to the east). G. Provide R-1 zoning labels on all four sides of this parcel (neighboring parcels). H. The scale noted does not match the plan graphics on the site. Update the graphics to match the scale noted or vice-versa. I. Update setbacks to correct dimensions on both the plan graphically and the lot setbacks table. 2. COMMENT: Per UDC Table 7.4.4-1 and under the Residential Use Group and Single-Family Dwellings, 2 spaces per dwelling unit plus visitor parking required at a ratio of 0.25 space per unit. Exception. Residential development in the R-1 zone must comply with Section 4.9.7.B.7. Per UDC Table 7.4.6-1, a 90-degree orientation requires a 8’-6” width by 18’-0” length per stall. Refer to Comment #1.A.1) (above) 3. COMMENT: Per TABLE 6.4.5.C.1.a., “For single-family and duplex development, the minimum required street perimeter yard is 20’-0” measured from the street property line” Based on the proposed design, it appears this will not only not meet the code standard requirement but not meet the parking requirement in comment 2 (above) if intended as a ‘living space’. A couple options exist: A. Shorten design to meet 20’-0” setback standard. B. Leave the design presented and attempt to secure relief from this standard through the Board of Adjustment Variance process. See below for more information on the B/A Variance process. Zoning cannot approve this permit until the Board of Adjustment (B/A) Variance Process is completed and approved. See below for more information on the B/A Variance process. 4. COMMENT: 3. Per UDC Article 6.6.3.D; Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted shall be the same as for the principal structure. Based on google street view, this structure appears to exceed the allowed 12’-0” height. A Board of Adjustment for Variance will be required to permit the shade structure as shown on the plan. See variance requirements below. An option would be to connect the shade structure to the existing residence with a 5’ wide roof structure that can support a 20-pound live load. Zoning cannot approve this permit until the Board of Adjustment (B/A) Variance Process is completed and approved. See below for more information on the B/A Variance process. 5. COMMENT: Per UDC Table 6.3-4.A., the setback distance from a residential use to an adjacent residential use, updated in Ordinance 12219 is now 5’-0”. Currently, you are showing a 6’-0” or 2/3 height of a proposed structures wall height in the ‘lot setbacks’ table. Update plan graphics and table accordingly. 6. COMMENT: After reviewing the property documentation history in Property Research Online (PRO), zoning could not verify any permit documentation for the following. A. Structure to the north of the residence built around 2023 approximately. B. Shade Sail was installed around 2023 approximately. Zoning will not be able to approve the permit application until the permit information is provided. If permit documentation cannot be provided, all structures less than 200 square feet (sf) can be included in this permit. A separate permit will be required if size exceeds 200 sf and/or has utilities serving it. 7. COMMENT: Additional comments may be forthcoming on the next review based on responses to Zoning and other PDSD reviewer comments. Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration.
