A single-family residence is a permitted use in this zone (Table 4.8-2). 1. Comment: The surrounding zoning classifications are incorrect. This property is surrounded by MH-1 zoning. Please update accordingly. 2. Comment: Please dimension all setbacks for the shed including to the West property line. This subdivision was developed utilizing the Residential Cluster Project. Per the final plat, there is a 10’ rear yard setback. The shed was not dimensioned to the West property line however it cannot be set within this 10’ setback. You have 3 options: a. Move the shed to meet the required 10’ setback from the West property line. b. Obtain a neighbor waiver from the adjacent homeowners association. The neighbor waiver would need to be included on the site plan. Here is an example of the neighbor waiver for detached accessory structures: The following statement can be used. My Name is __________________ and I am the owner of the property located at ________________________. I have reviewed the site plan and I have no objection to structure being located or constructed ______ feet from the property line as depicted on the site plan. Signature:_____________________________Date:____________________________ c. Apply for a Design Development Option (DDO) to reduce the minimum required rear yard setback. Since your plans were not properly dimensioned to the West property line, I cannot leave DDO comments without the setback accurately shown on the plans. If you choose to go the DDO route, please dimension the shed to the West property line so DDO comments can be made. 3. Comment: Additional comments may be forthcoming depending on responses to zoning review comments and plans submitted.
