1. This project lies within a recognized floodplain and requires a Floodplain Use Permit (FUP) with an elevation certificate. The base flood elevation (BFE) is 2439.5ft NAVD88. This requires that the finished floor elevation (FFE) be constructed at a minimum of 2440.5ft NAVD88.

Provide a detailed response letter with your next submittal that clearly shows how you have addressed all Zoning comments.

This site is located in the R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, .9, & .10.

Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Where the wall meets the eave of the roof. As height dimensions from design grade were not provided Zoning has added 6” to the heights provided.

Per UDC Table 6.3-2.A the minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line.

1. Based on a wall height of 12’-6” the required perimeter yard setback from the detached shop to the south property line is 8’-4”, proposed setback is 6’-0”. A neighbors setback waive may be used to reduce the perimeter yard setback from a detached accessory structure to an interior property line, UDC Article UDC Article 6.6.2.D. To secure this neighbor’s setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):

If you are not able to secure this waiver the Design Development Option (DDO) mentioned below can be used to reduce this setback.

COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment (UDC Section 3.10.1).

1. Per UDC Article 6.6.3.D Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. Per UDC Article 6.4.4.A Measurement of Building Height, building height is the vertical distance measured from the design grade elevation to the highest point of a flat roof; to the deck line of a mansard roof; or to the middle (between the eave and ridge ) of the highest gable of a pitched or hipped roof, except as follows: (See Figure 6.4.4-A, Measurement of Building Height .) Provide a building height measurement from design grade to the midpoint of the pitched roof. Based on the 12’ dimension to the bottom of truss the proposed shop exceeds the allowed 12’ height.

A Board of Adjustment for Variance must be submitted and approved to allow the greater than 12’ height.
