Residential Solar (1st Review)

TRANSMITTAL DATE: 06/09/2025

This site is located in the MH-1 zone (UDC 4.7.10). A single-family residence is a permitted use in this zone (Table 4.8-2).

01. COMMENT: Per UDC Table 6.3-2.A, the minimum rear and side yard setbacks are 6’-0” or 2/3 the height of the exterior building/structure wall, whichever is greater. Based on the proposed ground mounted solar with a maximum height of 5’-6”, the required setback would be 6’-0”. The setback for the proposed structure is 4’-6” from the south property line.

Per UDC Article 6.6.2.D, a detached accessory structure within a perimeter yard shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built up to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the site plan and be signed and dated by the adjacent property owner (702/704 W GLENN ST):

My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.

Signature: _____________________________

Date: _________________________________

02. COMMENT: Based on aerial photos it appears that the existing storage sheds (one on the southeast property line and three on the southwest property line) appeared between 2006 and 2010. Zoning was not able to find approved permit documents for these additions. They also appear to not meet setbacks on the south, east, and west property lines, which are 6’-0” or 2/3 the height of the exterior wall, whichever is greater.

As stated in comment 1, detached accessory structures may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the site plan and be signed and dated by the adjacent property owner(s) (702/704 W GLENN ST, 713 W FLORENCE ST, 643 W FLORENCE ST):

My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.
