Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

The following comments are relative to an application for a Board of Adjustment variance (UDC 3.10.3) or a Design Development Option (DDO) (UDC 3.11.1).

1. Remove the existing porches from the lot coverage calculation as roofed areas, open on at least one side, which provide shelter to exterior areas, provided they are not used for utilities, maintenance, laundry, storage, or motor vehicle parking, are excluded from the lot coverage calculation (UDC 6.4.3.C.1.a).

2. The street perimeter yards shown on the site plan are incorrect. In April of 2023, the Mayor and Council adopted several code amendments that included changes to street perimeter yards.

Country Club Road is identified on the Major Streets and Routes Plan as an arterial street with a future right-of-way width of 100 feet. The current right-of-way width of Country Club Road at this location appears to be 80 feet. Assuming this street will be widened to its proposed width, a side street perimeter yard of 20 feet is required for the proposal. A Board of Adjustment variance is required to be granted to reduce the side street perimeter yard to less than 20 feet.

3. Perimeter yards are based on a measurement from the design grade elevation to the highest point of an exterior building wall (see UDC 6.4.5-B and Figure 6.4.5-A). Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required side and rear perimeter yards are six feet or 2/3 the height of the exterior building wall, whichever is greater.

Based on a post height of 10’-0”, the required side and rear perimeter yards are 6’-8” as measured from the north and west lot lines. The proposed side and rear perimeter yards are 1’-0” as measured from the edge of the roof overhang.

Neighbor setback waivers in accordance with UDC 6.6.2.D may be utilized to reduce the side and rear perimeter yards to 1’-0”. The waivers shall be obtained from the owners of 3041 East 20th Street, 902 South Country Club Road, and 3032 East 19th Street. The waivers shall be pasted on the site plan and shall include the following language:

If all required neighbor waivers cannot be obtained, a Design Development Option (DDO) may be pursued for this project.

4. Per UDC 6.6.3.E, the total gross floor area (gfa) of all accessory structures shall not exceed 50% of the gfa of the principal structure. As the existing detached carport exceeds 50% of the gfa of the principal structure, a Board of Adjustment variance is required to be granted to allow the carport to exceed this requirement. If the proposed carport is at least twenty feet from the east lot line and is reduced in size, a DDO may be utilized for this project.
