The following comments are relative to an application for a Board of Adjustment variance (UDC 3.10.3). 1. This Site Zoning comment has not yet been addressed. In April of 2023, the Mayor and Council adopted several code amendments that included changes to street perimeter yards. Country Club Road is identified on the Major Streets and Routes Plan as an arterial street with a future right-of-way width of 100 feet. The current right-of-way width of Country Club Road at this location appears to be 80 feet. Assuming this street will be widened to its proposed width, a side street perimeter yard of ten feet is required as measured from the future street property line. A proposed perimeter yard of zero feet is proposed. A Board of Adjustment variance is required to be granted to reduce the side street perimeter yard to ten feet as measured from the future property line, unless written clarification from the Department of Transportation and Mobility indicates Country Club Road will not be widened. 2. This Site Zoning comment has not yet been addressed. Perimeter yards are based on a measurement from the design grade elevation to the highest point of an exterior building wall (see UDC 6.4.5-B and Figure 6.4.5-A). Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required side and rear perimeter yards are six feet or 2/3 the height of the exterior building wall, whichever is greater. Based on a post height of 10’-0”, the required side and rear perimeter yards are 6’-8” as measured from the north and west lot lines. The proposed side and rear perimeter yards are 1’-0” as measured from the posts of the carport. Site Zoning acknowledges a five-foot-wide connection is proposed to connect the new carport to the principal building. As the proposed carport is now considered attached to the principal building, a Board of Adjustment variance is currently required to be granted to reduce the side and rear perimeter yards to 1'-0". The submitted Design Development Option (DDO) application can be used to reduce the above setback requirements only if the carport meets the ten foot setback measured from the future property line.
