Detached shade structure (1st Review)

Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

The following comments are relative to an application for a Board of Adjustment variance (UDC 3.10.3).

The site is in the R-1 zone (UDC 4.7.8). A single-family residence is permitted in the R-1 zone, subject to use-specific standards 4.9.7.B.5-.9.

1. Provide a site plan that meets the residential plot plan requirements found at: https://www.tucsonaz.gov/files/pdsd/forms/Residential_Plot_Plan_Requirements.pdf. The requirements are depicted both graphically and in written form within this link.

2. Show the square footage of the lot, existing dwelling, all accessory structures, and total under roof area on the site plan.

3. Include a lot coverage calculation on the site plan. Per Tucson Unified Development Code (UDC) 6.4.3.B, lot coverage includes the area of the lot covered by buildings, outdoor storage areas, and vehicular use areas (both paved and unpaved). Lot coverage shall not exceed 70% of the total lot size per UDC Table 6.3-2.A.

4. Provide setback dimensions from the north, east, and west property lines to the proposed detached shade structure. Per UDC 6.4.5.C.1.a, the required front street perimeter yard setback is 20 feet. Include a 30-foot dimension from the centerline of Scarlett Street to the front street property line to ensure setbacks are depicted correctly.

Additionally, per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required side and rear perimeter yard setbacks are six feet or 2/3 the height of the proposed wall, whichever is greater, measured from the property line. Based on a wall height of 10’-0” for the proposed shade structure, the required side perimeter yard setbacks are 6’-8”.

5. A narrow structure along the east side of the existing residence appears in aerial photography beginning in 2019. Additionally, a ramada appears along the east property line in Pima County Pictometry aerial photography on March 17, 2022. The Zoning Review Section was unable to determine whether a permit was obtained for these structures. Either provide permit documentation for these structures or include it within this permit’s scope of work. As the structures do not meet setback requirements, a neighbor’s setback waiver signed by the property owner of 6660 East Scarlett Street may be utilized to eliminate the setback requirement. The following waiver text shall be signed and directly pasted onto the site plan:

6. Provide permit documentation for the porch that abuts the west property line. If detached, the above neighbor’s setback waiver process may be utilized and signed by the property owner of 6644 East Scarlett Street. If attached to the residence, a Board of Adjustment variance is required to allow the porch to remain with a zero-foot setback if permit documentation does not exist.

7. Per UDC 6.6.3.C, detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line.

For your information, zoning code amendments effectuated by the Mayor and Council on April 21, 2023, allow detached accessory structures up to 400 square feet to be constructed in the front yard ten feet from the front street property line. A Board of Adjustment is required to allow a shade structure of this size to remain detached in the front yard.

8. Per UDC 6.6.3.E, the total gross floor area of all accessory structures shall not exceed 50% of the gfa of the principal structure. Accessory structures less than 200 square feet are exempt from this requirement. The proposed detached shade structure exceeds 50% of the gfa of the existing residence. A Board of Adjustment variance is required to allow this structure to exceed this requirement. 9. The construction of a pool in the rear yard appears in Pima County Pictometry aerials on March 17, 2022. A residential pool requires a permit. Either provide permit documentation for this pool or apply under application type “Residential Pool/Spa” on the Tucson Development Center Online.
