This site is located within the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed.

1. Neither a neighbor waiver from the neighbor to the west has been applied to the site plan nor a Board of Adjustment (BofA) variance application has been submitted and approved for allowing a 4’7” encroachment into the west side yard. This was discussed in the April 23, 2026 Site Zoning review comments for numbers 1 and 2. If a neighbor waiver is not possible, apply for a BofA variance.

Board of Adjustment application/requirements can be found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications/Zoning-Administration. Contact for the Board of Adjustment is Mark Castro at Mark.Castro@tucsonaz.gov Until the variance is approved and the appeal period completed, do not resubmit the materials for TC-RES-0326-01045 until the BofA decision letter has been uploaded with response letter and all necessary construction and site plan documents. Otherwise, Site Zoning will not be able to approve the application.

Just in case a neighbor waiver is possible, it needs to be added to the site plan (snip and paste or directly applied to the site plan) and no variance is required. Below is an example of the neighbor waiver:
