A structure greater than 200 SF may not extend to a point closer than 3 feet from the neighboring property line without fire rated protection for fire spread. Provide compliance with R302.1 (City of Tucson Amended) by providing a fire spread barrier in compliance with IBC Table 721.1(2). This site is located within the R-1 Zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Please correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed.

1. Staff acknowledge receipt of your questions relating to the shade structure and needing further explanation of the comments from 4/23/26 by Jeffrey Cassidy and on 5/20/26 by myself, Roxanne Johnston. The shade structure is located 5 inches from the west property line. The reason the violation was issued is because the structure is located within the required 5 foot side setback where nothing is supposed to be constructed without City review and approval. The comment made by me that the structure encroached 4’7” into the side setback simply means that it showed to be 5 inches from the property line on your side, not over the property line into the neighbor’s side – I added 5 inches to the 4’7” to arrive at 5 feet.

Both Jeffrey and I supplied you with our email addresses. Please always feel free to email us to avoid having to resubmit questions through the portal. We are happy to assist.

Both Jeffrey and I also provided you with options on how to proceed with getting the shade structure approved. You always have the option to remove the structure. These are your choices:

a. Provide a neighbor waiver from the property owner to the west. Jeffrey pointed out In his review that if the neighbor who reported the non-permitted shade structure may not be agreeable to providing a neighbor waiver, so you would need to:

b. Apply for a Board of Adjustment Variance. I basically stated the same thing. I have reviewed the site plan and I have no objection to structure being located or constructed ___ inches/feet from the property line as depicted on the site plan. 2. Please do not resubmit the materials and a response letter until either the neighbor waiver is supplied (again, applied directly to the site plan – many folks forget!) OR the Board of Adjustment Variance has been approved. If the Board of Adjustment variance has been approved, then please upload a copy of the decision letter, new site plan, and response letter addressing ALL staff comments.
