Zoning recommends that you use the approved plot plan found at: https://pro.tucsonaz.gov/permitdetails/T00CM01164/, and remove all prior approval stamps and clearly show the proposed shed along with the proposed perimeter yard setbacks. 2. Per UDC Article 8.7.3.L.1 the required interior perimeter yard setback is 3’-0”, proposed perimeter yard setback from the shed to the south property line is 2’-0”. At a minimum a neighbors setback waive is required. Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor’s setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ If you are unable to secure the required setback waiver a Board of Adjustment for Variance will be required to reduce the setback. 3. Per UDC Article 8.7.3.K.1 Perimeter yards along FLD project site boundaries are required in accordance the site ’s underlying zone as provided in Section 6.3.4, Dimensional Standards and Exceptions Tables. Per UDC Table 6.3-4.A, C-2 Zone, Residential Use to a Non Residential Use the required perimeter yard setback from the proposed shed to the east property line is 10’ or ¾ the height of the exterior wall, greater of the two. Based on a wall height of less than 13’-4” the required perimeter yard setback from the proposed shed to the east property line is 10’0”, proposed setback is 3’-0”. The setback waive may also be used to reduce this setback. Depending on how comment 2 is addressed if you are not able to secure the neighbors setback waiver if you elect to go the Board of Adjustment route for comment 2 this reduced setback can be included in the Board of Adjustment process. If you are able to secure the setback waiver for the setback mentioned in comment 2 or you relocated the shed to meet the required 3’ setback and wish to keep 3’ setback to the east property line a Design Development Option (DDO) can be use to reduce the setback.
