Unfortunately we cannot legally allow the approval of this permit of a fence/wall over 7ft without a structural engineer looking at your plans and their seal of approval. Any other fence/wall in your neighborhood over 7ft without a Arizona registrants approval is also not in compliance. Please either reduce the height of the fence or obtain an engineers stamp for us to approve this permit. This is a matter of building safety for your property and others. Again I fully understand your frustration but must follow the city laws. | 04/17/2025 | Site Zoning | REQUIRES RESUBMIT | FROM: PDSD Zoning Review Section PROJECT: TC-RES-0325-01128 2008 N Bell Ave. – R-2 Site fence (2nd Review) TRANSMITTAL DATE: April 17, 2025 COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This site is located in the R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, .9, & .10. 1. Clarify which plot plan you are going to use. One shows the distance from center line of Bell to the property line as 28’ and the other 30’. Neither plot plan has the correct property dimesons and shape. Neither plot plan clearly shows where the proposed fence is located. Neither plot plan is to scale. Provide a residential plot plan that meets the requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Building-Safety/Plan-Examples/Plot-Plan-Example, to include but not limited to: a. Clearly show the curb along Bell Ave. and provide a dimension from the center line of Bell to the face of curb, where pavement meets the concrete curb and from face of curb to the west property line. Per Construction plan I-852, sheet 16, found at: https://maps-and-records.tucsonaz.gov/construction-plans/details/I-852, the distance from centerline to face of curb is 18’ and from face of curb is 12’. These dimensions are needed to ensure the proposed fence is located on your property. 2. As you have elected to use the Design Development Option (DDO) until the DDO is approved and the above comment is addressed correctly Zoning cannot approve this permit. Per UDC Article 6.6.2.I The maximum height of a wall or fence within a perimeter yard shall be six feet; however, the wall or fence may be higher than six feet, but no higher than ten feet, if: (See Figure 6.6.1-A, Height of Wall or Fence within a Side or Rear Perimeter Yard .) If you do not meet one of the four exceptions listed above a Design Development Option (DDO) for wall/fence height must be submitted and approve.
