04/08/2024 | Site Zoning | REQUIRES RESUBMIT | FROM: PDSD Zoning Review Section PROJECT: TC-RES-0324-01341 820 N 3RD AV. – HR-3 SFR w/Garage (1st Review) TRANSMITTAL DATE: April 8, 2024 COMMENTS: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This site is located in the HR-3 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6. 1. The lot coverage calculation is not correct. Per UDC Article 6.4.3.B.3.b Vehicular use areas, measured within the outside edges of any area allocated to vehicle use, whether improved or unimproved are included in the lot coverage. 2. The proposed 2’-0” perimeter yard setback to the south property line shown encroaches into the 5’ utility easement mentioned above. Writer permission allowing the encroachment from all utilities that have rights to this easement is required. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. 3. Based on aerial photos there is what appears to be a shed shown in the northeast corner of the property that appears sometime after 2005. Zoning was not able to find approved zoning compliance documents for this shed. Provide the height of the exterior walls and perimeter yard setback dimension. It does not appear that the shed meets required perimeter yard setbacks, the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Historic Review may waive setback requirements. 4. The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Based on the wall height of 15’-4” provided, the required perimeter yard setback from the SFR to the south property line is 10’-3”, proposed setback is 5’-0”. Based on the wall height of 21’-4” provided, the required perimeter yard setback from the SFR to the east property line is 14’-3”, proposed setback is 4’-6”. Historic Review may waive setback requirements. If Historic does not waive the reduced setbacks a Design Development Option (DDO) must be submitted and approved to reduce the required setback.
