New Accessory Dwelling Unit (ADU) (1st Review)

TRANSMITTAL DATE: April 1, 2025

COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the MH-1 zone (UDC 4.7.10). A single-family residence (SFR) with an accessory dwelling unit is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, 8, & 9 and 6.6.3.

1. Per UDC Article 6.6.3.C Detached accessory buildings , including accessory dwelling units , are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line, front yard, except for shade structures or carports not over 400 square feet in floor area , terraces and steps not over three feet high above the natural grade, paved areas, and fences or walls. The proposed ADU is located in the front yard and a Board of Adjustment for Variance will need to be submitted and approved prior to approval of this permit.

2. Based on aerial photographs there is a structure located near the middle of the site that shows up some time after 2010 and a storage container south of that structure, that shows up some time after 2020 and a carport structure at the east end of the existing dwelling shows up some time after 2022. Zoning was not able to find approved permit/compliance review documents for these structures. Either, 1) Provide approved permit/compliance review documents for these structures, 2) Provide building plan documents for these structures and permit or, or 3) show the structure to be removed from site. Building permits will be required for any structure greater than 200 sq. ft or any structure that has utilities to it, i.t. electrical, plumbing etc.

3. The structure located near the middle of the site and the storage container will required a Board of Adjustment based on UDC Article 6.6.3.C, mentioned in comment 1.
