A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9 for 1 unit; 4.9.7.B.1 - .9, & .11 for 2 units (min. 10,000 sq ft lot size required). Plan review for the above referenced shed has been completed. This letter reflects comments to be addressed. For facilitating a shorter back check time, please provide updated plans and calculations with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment updates; revisions are processed if changes occur after the permit is issued. The City's Unified Development Code (UDC) (Section 1.4.1.C) establishes that before the City issues any approvals or permits; we must confirm that a site complies with UDC standards. Therefore, as part of permit reviews, we review a site's permit history and compare it to aerial photography to confirm that unpermitted work has not occurred. In many cases, this does mean that a homeowner must apply for permits for unpermitted work before we can approve any new work on that site. 1. COMMENT: The submitted site plan shall be a copy of the stamped approved Development Package, and the proposed duplex shall be clearly marked. 2. COMMENT: The site plan provided is incomplete. Provide a site plan that meets the requirements show in the plot plan example at the following link: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example Specifically: A. Draw, label and dimension everything that exists on the property. Provide heights of both sheds (missing the shed on the east side of the property with the shade sail attached to it). Label unpermitted shade sail as well. B. Draw, label and dimension all setbacks. Setbacks for east and north property lines are 6’-0” or 2/3 the height of any structure flanking those property lines, whichever is distance is greater. The front yard setback is 20’-0” (likely E Calle Playa). The street side yard setback is 10’-0” (likely N Avenida Ricardo Small). In the case of a ‘corner lot’, like this example (fronting on two streets), the property owner can choose which is which. Update plan and associated content accordingly. Additionally, include this in the required comment response letter. C. Adjust the zoning classification to R-1 and label the neighbors zoning to the north and east as the same R-1 classification. D. The scale noted does not the plan graphics on the site. Either update the graphics to match the scale noted or vice-versa. E. Add a north arrow. 3. COMMENT: A rear porch expansion appears to have taken place in the late part of 2005 without a permit. Zoning was not able to find approved permit documents for this carport. Either 1) provide approved permit documents, 2) include the porch in the permit, or 3) show the porch to be removed from site. Include your desired choice in the comment response letter. 4. COMMENT: An additional shed appears to be located along the east side of the residence without a permit. Zoning was not able to find approved permit documents for this carport. Either 1) provide approved permit documents, 2) include the shed in the permit, or 3) show the shed to be removed from site. Include your desired choice in the comment response letter. 5. COMMENT: A shade sail appears to be located along the east side of the residence without a permit. Zoning was not able to find approved permit documents for this shade sail. Either 1) provide approved permit documents, 2) include the shed in the permit, or 3) show the shade sail to be removed from site. Include your desired choice in the comment response letter. 6. COMMENT: Regarding both sheds: Depending on the height of the sheds and how close they are located to the adjacent property line(s), both sheds are potentially located in the west and east setback(s). Per TABLE 6.3-2.A of the UDC (referenced below), the perimeter yard setback(s) along the east, and west property line(s) are 6’-0” (east) 10’-0” (west) or 2/3 (east) ¾ (west) the height of the sheds, WHICHEVER DISTANCE IS GREATER. Depending on how far these sheds sit off these property lines, there are three options: A. 1’-0” or more or 1-0” OR Less (encroaching in setback): Secure a neighbor setback waiver (provided below) signed and dated by the property owner(s) to the east (this option only applies to shed along the east property line): (Neighbor Waiver Sample – Copy and Paste, exactly as shown, onto Site Plan): My Name is __________________ and I am the owner of the property located at ________________________. I have reviewed the site plan and I have no objection to structure being located or constructed ______ feet from the property line as depicted on the site plan. Firma: _________________________Fecha:__________________________ B. 1’-0” or more from property line and unable to obtain neighbor waiver: If unsuccessful in the attempt to retrieve the neighbor waiver to the east, there is a Design Development Option (or DDO) which affords an attempt to seek relief from the setback requirements. Know this is an extra 6-week review and the neighbors within 100’-0” are made aware of this attempt to seek relief from being in the setback. Zoning will not be able to approve the permit application until the DDO is approved.
