02/28/2024 Site Zoning REQUIRES RESUBMIT ZONING REVIEW TRANSMITTAL

FROM: Wyatt Berger

PROJECT: TC-RES-0823-07103
5843 East 31st Street – R-1
Enclose carport into bedroom suite (1st Review)

TRANSMITTAL DATE: February 28, 2024

Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

The site is in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in the R-1 zone, subject to use-specific standards 4.9.7.B.5-.9.

1. The depth of the lot provided on the site plan is incorrect and should be corrected to 102’.

2. As it appears the “existing covered patio” on the site will be enclosed, include the proposed family room within the lot coverage calculation. Lot coverage shall not exceed 70% in the R-1 zone (UDC Table 6.3-2.A).

3. The proposed family room is considered a bedroom. Per use-specific standard 4.9.7.B.7, for any single-family dwelling in the R-1 zone with five bedrooms, three parking spaces are required. For every bedroom over five, one additional space is required for each bedrooms. For all single-family dwellings in the R-1 zone with five or more bedrooms, all parking spaces must be located on-site, either in a side or rear perimeter yard. Parking spaces may not be located in a vehicular use area in any front street perimeter yard.

Per UDC 11.4.3, the term “bedroom” includes all of the following: 1) Any room that is designated as a bedroom; 2) Any enclosed room that has a minimum area of 60 square feet and has an accessible opening to the exterior of the building in compliance with the International Building Code (IBC), whether termed a studio, family room, study, den, bonus, or any other name, except for a living room, dining room, kitchen, and bathrooms; and 3) Any room designated as a bedroom for the purpose of any other code requirement.

Please note that per a previous Zoning Administrator’s determination dated June of 2005, the family room will not be considered a bedroom if a five-foot-wide opening with no doors connects to the existing dining area. Provide a dimension demonstrating that the proposed opening is at least five feet wide.

4. Two detached accessory structures in the rear yard appear in aerial imagery in 2020. A zoning compliance review was not obtained for these accessory structures. Provide the maximum height of these accessory structures as well as the perimeter yard setbacks as measured from the east lot line.

Per UDC Table 6.3-2.A, the required perimeter yard setback is 6’-0” or 2/3 the height of the exterior building wall, whichever is greater, measured from the east lot line.

As it does not appear these accessory structures meet the above setback requirement, a signed neighbor’s setback waiver in accordance with UDC 6.6.2.D may be used to reduce the setback. The waiver shall be signed by the property owner of 5851 East 31st Street and pasted directly on the site plan. The waiver shall also include the following language:

My name is _______ and I am the owner of the property located at _______. I have reviewed the site plan and I have no objection to the structures being located __ feet from the property line as depicted on the site plan.
