This site is located in the R-1 zone (UDC 4.7.9). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.6, .9, & .10.


1. Comment: Clarify the height of the proposed structure. On the site plan the height of the proposed structure listed is 10’. On the structural sheet 1 the height of the structure listed is 11’-10 3/8”. Which height listed is correct? Correct the height of the structure to match on all sheets.
2. Comment: Clarify, is this proposed Tuff Shed garage accessory for vehicular use or storage or both?
3. Comment: Per UDC 6.3-2.A, All structures must meet the minimum building setback, the greater of 6’ or 2/3 the height of structure wall facing the property line. The proposed structure setback depicted is 6’ from the west property line.

2/3 (height of structure wall) of 11’- 4 ½” (Using the ¼” = 1’ scale provided) is a 7.58-foot required setback along the west property line, minimum. On the site plan a 6’ setback is depicted from the proposed structure to the west property line and is not in compliance with UDC 6.3-2.A.

The shed can be relocated away from the west property line to meet the 7.58-foot minimum setback or a waiver for the proposed setback must be obtained to allow the shed to be built / placed as depicted on the plan. The following verbiage can be used for the setback waiver and must be Added to the site plan. The statement may be in English or Spanish.

Example of an adjacent owner’s setback waiver for detached accessory structures. The adjacent owner’s waiver statement must be Added to the site plan.

The following statement can be used. My Name is __________________ and I am the owner of the property located at ________________________. I have reviewed the site plan and I have no objection to structure being located or constructed ______ feet from the property line as depicted on the site plan.

If you are unable to secure a waiver a Design Development Option (DDO) application must be submitted for review and approval.

The following comments are related to the DDO if necessary.

4. DDO Comment: The perimeter yard setback along the west property line does not comply with the minimum setback. Per UDC 6.3-2.A, the minimum perimeter yard setback is the greater of 6’-0” or 2/3 (H) height of the exterior wall. The structure encroaches into the required perimeter yard (7.58) at 6’ and will require the approval of a Design Development Option (DDO) before zoning can approve this permit.
The below paperwork can be filled out and submitted with the next submission.
