COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the RX-2 zone (UDC 4.7.7).

1. Per UDC Article 6.6.2 An accessory building shall be built only on a lot occupied by a principal building or use. That said the proposed shed is not allowed on this site by itself. At best a Board of Adjustment for Variance will need to be submitted and approved to allow a shed by itself on this site. Zoning acknowledges that it appears you are proposing to build a single family residence but until the building permit is approved and issued Zoning cannot approve this permit.

2. The plans call out a 13’ height for the proposed shed. Per UDC Article 6.6.3.D accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. Building height is the vertical distance measured from the design grade elevation to the highest point of a flat roof; to the deck line of a mansard roof; or to the middle (between the eave and ridge ) of the highest gable of a pitched or hipped roof, except as follows. See UDC Article 6.4.4.A & Figure 6.4.4-A. Provide building elevations with the building height clearly dimensioned so that the proposed height can be verified. A Board of Adjustment for height maybe required.

3. The proposed 10’-0” perimeter yard setback shown from the proposed shed to the west property line does not meet the required 20’-0” perimeter yard setback, UDC Table 6.3-1.A. A minimum a neighbor setback waive will need to be secured, UDC Article 6.6.2.D. If you are not able to secure the waive a Design Development Option (DDO) will be required to reduce the setback.

To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by a Board Member of the Richland Heights Townhouse Assn. for the property to the west.
