This site is located in the RX-1 zone (UDC 4.7.6). A single-family residence is a permitted use in this zone (Table 4.8-1) subject to Use Specific Standards 4.9.7.B.6, .8, & .9.

COMMENTS: Please resubmit revised drawings and a detailed response letter, which states how all Zoning Review Section comments were addressed.


1. Comment: List under the site information –

A.) The legal description of this address – “HEARTHSTONE ACRES LOT 7”

2. Comment: Label the Zone (RX-1) and all adjacent zones on the site plane. Or show a zoning detail of this properties zone and all adjacent property zones. 3. Comment: The front street setback listed under the site information is not correct. Front street setbacks are 20’ (not 30’), per UDC 6.4.5.C.1. (https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-5192 )

4. Recent aerial views show an unpermitted pergola has been built and attached to the southeastern wall of the home, sometime after 2023. No documentation can be found indicating this pergola was built with permits.

This unpermitted pergola will need to be permitted and included in this permit. Either provide the pergola permit documentation clearly depicting it was permitted legally, include the unpermitted pergola information in this permit, or state the pergola will be removed. If the pergola is no longer standing then indicate that it has been removed.

5. Comment: Per UDC 6.6.3.D., Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted shall be the same as for the principal structure.

The proposed metal accessory structure shall not exceed 12 ft in height. Using dimensions provided on the elevation sheet of the plan, the metal accessory structure is greater in height than 12 ft measured from design grade (where the ground/dirt meets the structure).

At a minimum a Board of Adjustment Variance is required. Zoning cannot approve the proposed permit application of the metal accessory structure because the height of the structure exceeds the maximum height (12 feet) allowed for detached accessory structures. Please contact Mark Castro, mark.castro@tucsonaz.gov, for the Board of Adjustment (UDC Section 3.10.1) process.

6. Comment: Additional comments may be forthcoming on the next review based on the proposed use for the addition and applicable use specific standards.
