01/18/2024 Site Zoning REQUIRES RESUBMIT ZONING REVIEW TRANSMITTAL

FROM: Wyatt Berger
Lead Planner

PROJECT: TC-RES-0124-00247
320 North Banff Avenue – R-2
New garage (1st Review)

TRANSMITTAL DATE: January 18, 2024

Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

1. Provide a site plan that meets the residential plot plan requirements found at: https://www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/permits/residential-permits/residential_plot_plan_requirements.pdf. The requirements are in both graphic and written formats.

2. Provide front street and side street perimeter yard dimensions. Per Tucson Unified Development Code (UDC) 6.4.5.C.1.b, where a lot abuts more than one street, the owner chooses which street lot line is the front lot line. From other than the front lot line, the street perimeter yard is ten feet, as measured from the street property line. For carports and garages which face the street, the minimum required street perimeter yard is 20 feet regardless of the street.

3. A narrow structure along the east lot line appears in aerial photography in 2010. This structure was not reviewed by the Planning and Development Services Department and does not appear to meet the required perimeter yard. Include the structure within the scope of work of TC-RES-0124-00247 or indicate whether the structure will be removed or demolished.

Per UDC Table 6.3-2.A, when a residential use is adjacent to a residential zone, the required interior perimeter yard is 6’-0” or 2/3 the height of the exterior building wall, whichever is greater. Indicate the existing perimeter yard measured from the exterior wall to the east lot line.

As this structure does not appear to be attached to the principal structure with a structural element, a neighbor’s setback waiver in accordance with UDC 6.6.2.D may be utilized to reduce the perimeter yard. The waiver must be signed by the owner of 314 North Banff Avenue and must be pasted directly onto the site plan. The waiver shall include the following language:

My name is ________ and I am the owner of the property located at ________. I have reviewed the site plan and I have no objection to the structure being located __ feet from the property line as depicted on the site plan.

Signature: ________

Date: _________

If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951.
