This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9. 1. As the proposed site wall does not meet any of the 4 following requirements a Design Development Option (DDO) for wall height shall be submitted and approved. For any section of the wall over 6’-0” high. Zoning acknowledges that a partial DDO application was submitted but until the DDO is approved Zoning cannot approve this plan. The proposed 7’-0” & 6’-2” wall exceeds the allowed height of a all within the perimeter yard, see UDC Article 6.6.2.I. Per UDC Article 6.6.2.I The maximum height of a wall or fence within a perimeter yard shall be six feet; however, the wall or fence may be higher than six feet, but no higher than ten feet, if: (See Figure 6.6.1-A, Height of Wall or Fence within a Side or Rear Perimeter Yard.) 1. At least 75% of the area above six feet in height is left unobstructed and open through the use of architectural elements, such as arches, columns, or wrought iron; 2. Part of, or located on top of, a retaining wall no higher than ten feet measured from design grade and no higher than six feet measured from the top of the retaining portion of the wall; 3. A greater height is required through the rezoning process or the special exception land use process; or, 4. A greater height is required by a specific UDC standard. Either demonstrate that one of the four exceptions above are met or a Design Development Option for wall height will need to be summited and approved prior to approval of this plan.
