This site is located in the R-2 zone (UDC 4.7.9). A single-family residence with an Accessory Dwelling Unit is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9, and 6.6.3.


1. COMMENT: Per UDC Article 6.4.4.A, “Building height is the vertical distance measured from the design grade…”

Clarify the height shown on the Site Plan and the height on the Model Plan from design grade for the proposed northern wall height (9'4" or 8'4"?)

2. COMMENT: Per UDC Table 6.3-2.A, the required setback in the R-2 zone is the greater of 6 feet or 2/3 the height of the proposed building wall.

The proposed wall height from design grade for the northern facing wall is 9 feet 4 inches which requires a minimum 6 feet setback, the proposed setback is 4 feet 2 inches.

The proposed wall height from design grade for the northern facing wall is 14 feet 8 inches which requires a minimum 9 feet 9-inch setback. The proposed setback is 4 feet 7 inches.

The proposed ADU encroaches into the required side and rear yard setbacks.

The applicant has indicated, per the Comment Response Letter, that a Design Development Option (DDO) will be applied for. The DDO process must be completed and approved before this permit can be approved by Zoning.

12/22/2023 Zoning Modifications - DDO REQUIRES RESUBMIT If the perimeter yard requirements as described within the Site Zoning review cannot reasonably be met, a Design Development Option (DDO) is required to reduce the side perimeter yard to 4'-2" as well as to reduce the rear perimeter yard to 4'-7". Ensure consistent dimensions from the design grade elevation to the exterior wall's highest point based on approved TC-MDP-0223-00625 are provided (see UDC 6.4.5.B and Figure 6.4.5-A).
