This site is located in the R-2 zone (UDC 4.7.9). A single-family residence with an Accessory Dwelling Unit is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9, and 6.6.3.


1. COMMENT: Per UDC Article 6.4.4.A, “Building height is the vertical distance measured from the design grade…”

Per Model Plan permit number TC-MDP-0223-00625, the height should be shown from Finish Grade and not Finished Floor Elevation. Change the proposed wall heights as shown on the Site Plan to reflect the measurement requirement.

2. COMMENT: Per UDC Table 6.3-2.A, the required setback in the R-2 zone is the greater of 6 feet or 2/3 the height of the proposed building wall.

The proposed wall height from design grade for the northern facing wall is 8 feet 4 inches which requires a minimum 6 feet setback.

The proposed wall height from design grade for the northern facing wall is 14 feet 8 inches which requires a minimum 9 feet 9-inch setback.
The proposed ADU encroaches into the required side and rear yard setbacks.
A neighbor’s setback waiver may be utilized to reduce these required setbacks. The neighbor waivers shall be signed by the property owners of Pima County Tax Parcels Number 116-21-311A, 1408 W Congress St, & 116-21-311C. The signed neighbor waivers shall be directly pasted on the site plan and shall include the following text:
My name is ______ and I am the owner of the property located at ______. I have reviewed the site plan and I have no objection to the structure being located or construct __ feet from the property line as depicted on the site plan.
