(Comment) The submitted plans indicate the proposed use for this property to be a “hookah shop”. Per the City of Tucson’s Code of Ordinances (Section 7-427), this use classifies as a type of “smoke shop”. Per this section, a smoke shop “means any establishment in which the area used for sales or display of tobacco products consists of fifteen (15) percent or more of the total sales area of the space.” The submitted plans indicate that over 15% of the gross floor area will be dedicated to tobacco product retail. Tobacco products are defined as: “(1) any product made or derived from tobacco or that contains nicotine and is intended for human consumption or is likely to be consumed, whether smoked, heated, chewed, absorbed, dissolved, inhaled, or ingested by any other means, including cigarettes, cigars, pipe tobacco, chewing tobacco, shisha, snuff, snus, and liquid nicotine solution; and (2) any component, accessory, instrument, or paraphernalia that is used in the consumption of a tobacco product or that is solely designed for the smoking or ingesting of tobacco or shisha, including a hookah, water pipe, filter, rolling papers, pipe, or electronic smoking device…” 2. (Comment) Section 7-428 of the Code of Ordinances states that “no person may sell, furnish, give, or provide tobacco products directly to consumers within the City of Tucson except on the premises of a tobacco retail establishment with a valid license.” Section 7-435 states that “no person shall operate a smoke shop without first obtaining a smoke shop license.” Provide proof of licensure with next submittal. 3. (Comment) Per the Unified Development Code (UDC), Section 4.8-4, a smoke shop is a permitted use in C-1 zones subject to use-specific standards found in Section 4.9.9.H. Indicate how this development meets the use-specific standards in Section 4.9.9.H. in the comment response letter. 4. (Comment) This property is a nonconforming parcel which does not meet current UDC standards. Per UDC Section 9.1.4., it is incumbent on the applicant to provide proof that their use qualifies for a continuance of a nonconforming status under UDC Section 9.2. Although the comment response letter indicates that the prior use was “retail”, any pre-existing use does not by default qualify as a nonconforming use. Per the UDC, a qualifying nonconforming use must have been “lawfully established and maintained”. If this site does not qualify for continuance, per UDC Section 9.2.1.B, a site loses its nonconforming status upon a change of use and is required to fully meet the requirements of the UDC, to include for vehicular access, parking, ADA, landscaping, rights-of-way, and other standards. 5. (Comment) Per UDC Section 3.3.3.G.2.c, a development package is required to be submitted when a change of use occurs for a commercial development. Requirements for a development package can be found here: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Development-Package. Submit a development package application.
