ARCHITECTURAL COMMENTS

General

1. The permit application is for a tenant improvement to establish a home occupation providing adult day assisted services within an existing dwelling unit. The code analysis provided identifies the occupancy as Group R-3; however, based on the description of services, this use involves custodial care.

Per the 2018 IBC, Section 202, Custodial Care is defined as:
“Assistance with day-to-day living tasks, such as assistance with cooking, taking medication, bathing, using toilet facilities and other tasks of daily living. Custodial care includes persons receiving care who have the ability to respond to emergency situations and evacuate at a slower rate and/or who have mental or psychiatric complications.”

This definition aligns more closely with Group R-4, Condition 2, which covers facilities housing more than five but not more than 16 people receiving custodial care.

Additionally, IBC Section 310.4.1 states that care facilities for five or fewer people receiving care may be classified as a Group R-3 occupancy and considered within a dwelling. The scope of work indicates 10 people receiving care, which exceeds the R-3 allowance and would therefore require classification as Group R-4, Condition 2.
Please revise the occupancy classification and code analysis accordingly.

2. As a Group R-4 Condition 2 building this facility requires an automatic sprinkler system per 2018 IBC Section 903.2.8.3. Please indicate that an automatic fire sprinkler system is to be provided as part of this project and is to be submitted as a separate permit (not a deferred submittal).

10/31/2025 Site Zoning Standard REQUIRES RESUBMIT 1. COMMENT: The provided documentation indicates that this site is operated by Casa de Rosa LLC, which is a business operating multiple locations rather than a person operating a home occupation out of their residence. As such, this location does not appear to meet the definition of a "Home Occupation" per UDC 11.4.9. In addition, the type of certificate of occupancy for this use may also affect this determination. It appears that this use instead could be considered a "Commercial Services Use Group - Day Care (Adult Care)", subject to use-specific standards 4.9.4.B.1 and would be required to provide one parking space for every 300 sf of gross floor area. Please provide clarifying information about the proposed use, its ownership, and operation to support the proposed "Home Occupation" use.
