Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed.

The site is in the C-2 zone (UDC 4.7.21). A smoke shop is a permitted use in the C-2 zone, subject to use-specific standard 4.9.9.H.

1. (Comment) On November 14, 2023, the Mayor and Council approved an amendment to the Tucson Unified Development Code (UDC) to establish regulations for smoke shops. The regulations were effectuated on December 14, 2023.

To be considered a legal nonconforming use, a smoke shop is required to be vested through either an approved Certificate of Occupancy for the use or an approved business license. Zoning staff has determined that an approved business license was not obtained for this use at this location prior to December 14, 2023.

The submitted lease paperwork is not a substitute for a business license.

As such, this permit application would need to demonstrate how the proposed use complies with use-specific standard 4.9.9.H.

2. (Comment) UDC Section 4.9.9.H. states that “a smoke shop shall be a minimum of 1,000 feet from a K-12 public, private, or charter school, measured in a straight and direct horizontal line from the closest exterior or applicable interior suite wall of the smoke shop, to the closest property line of a school or childcare center.”

This site does not comply with this standard as Wakefield Middle School is located within 500 feet of the suite entrance.
