This site is located in the P-I zone (UDC 4.7.28). Smoke shop is not an allowed use in the zone. 1. Previous Comment: Per UDC Table 4.8-5 Retail Trade Land Use Group With Land Use Class/Type: a Smoke Shop is not an allowed use in the P-I Zone. Best case a Board of Adjustment for Variance maybe required but most likely a rezoning will be needed. An option would be to contact PDSD Zoning Administration an attempt to secure a nonconforming letter for this addressed. https://www.tucsonaz.gov/Departments/Planning-Development-Services/Planning-Zoning-Applications. **Follow up Comment: Prior to obtaining a Certificate of Occupancy, a zoning compliance letter will be required to determine whether the use (Smoke Shop) was legally established prior to the enactment of the new ordinance.
