Please cloud and delta all changes and provide a letter with a written response to each of the comments indicating the action taken.

The scope of this review covers the architectural, structural, plumbing, mechanical, and electrical designs as they relate to the codes adopted by the jurisdiction. All features were checked only to the extent allowed by the submittals provided. All portions of this project are assumed to meet or will meet other departmental requirements, conditions, and concerns before permit approval.

1. Previous Comment: Please provide proof that this project has been submitted to the Pima County Health Department for permitting. Make sure to incorporate any of their comments into any future submittals. Still Required: The second submittal did not include proof of submittal. Please provide the confirmation email or receipt that this project has been submitted to the Pima County Health Department.

Sheet A2

1. New Comment: The response to the fire department’s comment has added greater clarity regarding the entire building (i.e. the addition of a “site plan” on Sheet 1 of 1). It is unclear if you are trying to describe an “accessory” occupancy per 2018 IBC Sec. 508.2 or “separated mixed occupancy” per 2018 IBC Sec. 508. Further, the entire building as now presented is over the allowable area per 2018 IBC Table 506.2.
a. Allowable Area: The entire building is 72,694 square feet. Per 2018 IBC Table 506.2 the allowable area for a Group M Occupancy building is 50,000 square feet when sprinkled. So, without consideration for frontage increase per 2018 IBC Sec. 506.3 this building is over the allowable area. Now, either this building is divided up with “fire walls” per 2018 IBC Sec. 706, or maybe this building was originally considered a building of unlimited area per 2018 IBC Sec. 507.4, with the Group A-2 nightclub meeting the requirements of 2018 IBC Sec. 507.4.1 with exits directly to the exterior and “fire barriers” separating the A-2 from all other occupancies. The building will not work as a mixed use building with separated occupancies per 2018 IBC Sec. 508.4.2.
b. Accessory Occupancy: The entire building is 72,694 square feet. The Group M mercantile occupancies comprise 64,873 square feet. There is a Group A-2 nightclub consisting of 5,821 square feet, and you are adding an A-2 restaurant which is 2,000 square feet. Per 2018 IBC Sec. 508.2.3, the “aggregate accessory occupancies shall not occupy more than 10% of the main occupancy”. With the addition of the restaurant, the A-2 Occupancies will total 7,821 square feet which exceeds 10% of the building area. The A-2 Occupancies cannot be accessory uses. {The narrative on Sheet A-1 describes the restaurant as an “accessory” use.}
c. Unlimited Area Building: This Group M mercantile building is 72,694 square feet, has a fully automatic sprinkler system per 2018 IBC Sec. 903.3.3.1, and appears to have yards on all four sides exceeding 60 feet, which would qualify it as a building of unlimited area per 2018 IBC Sec. 507.4, except for the inclusion of the Group A-2 Occupancies. Per 2018 IBC Sec. 507.4.1 the Group A-2 occupancies would be allowed if they are separated from the Group M Occupancies with “fire barriers” and have their exits directly to the exterior.
Your present design describes “occupancy separation 1-hour fire rated walls” which tells us nothing. You appear to be describing “fire barriers” per 2018 IBC Sec. 707. {The term “occupancy separation” is an old term found in the Uniform Building Code (UBC) and does not apply to the International Building Code (IBC).}. I believe the following needs to happen:
• Determine this building is an unlimited area building per 2018 IBC Sec. 507.4 and 507.4.1 and stipulate on the plans. You will have to identify the existing fire barriers surrounding the nightclub, and the new fire barriers separating the new restaurant/mercantile from the adjacent occupancies.
• Remove references to “accessory uses” since this term does not apply to this design.
• The design of your “fire barriers” must meet the requirements of 2018 IBC Sec. 707, which includes extending the fire barriers to the bottom of the deck through concealed spaces per 2018 IBC Sec. 707.5. Currently Detail 8 on Sheet A7 shows the fire barriers stopping at the bottom of the joists.
• Present the total building area (overall square footage) of the existing building.
