1. I was not able to personally visit the site.
2. The proposed work applies entirely to the electrical system.
On Sheet 2, the Scope of Work describes the replacement of existing Meter Socket, Panel, Conductors, and Weatherhead with "like" components.This work would be in compliance with Exhibit 9, Paragraph 2(x) of the Settlement Agreement, and I have no objection to these "like" replacements.
3. However, the last statement on Sheet 2 regarding the Scope of Work says, "Install new 8' x 5/8" Ground Rods (2) and #4 (CU) Ground Wire." There is no mention of an existing grounding system. Exhibit 9 is quoted in the Scope, as if the statement " … in order to meet technical codes" means that CCO has the right to install an entirely new grounding system. I reviewed Exhibit 9 in its entirety. The purpose of this exhibit is to identify what components of the billboard may be replaced and how much of the billboard may be replaced. Once those limits have been met, the billboard cannot be further modified, and it must be removed. So Exhibit 9 is very limiting, and should be interpreted very narrowly. A grounding system apparently does not exist on this billboard. Just because the technical code has been changed does not mean that the Settlement Agreement no longer applies. Instead, the Agreement identifies the limits of ANY proposed modification. Exhibit 9, Paragraph 2(x) requires that the component being installed is "like" or "reasonably comparable." The proposed work is not "reasonably comparable." It is a huge change to the existing (obsolete) electrical system, which would not be allowed for the billboard structural system, for example. Read Exhibit 9 in its entirety. It identifies when a billboard is no longer viable. When components have been replaced to the limits described, the billboard can no longer be modified and must be removed. This electrical system on this billboard is now obsolete, according to the technical code. That code changed decades ago, not yesterday. The proposed addition of an entirely new grounding system is not in compliance with Exhibit 9.
4. On Sheet 2, the "Electrical Service (New)" does not show any grounding system, either existing or proposed.
5. And again on Sheet 2, the "One-Line Diagram" also does not show any grounding system, either existing or proposed.
