04/17/2024 | Site Zoning | REQUIRES RESUBMIT | ZONING REVIEW TRANSMITTAL FROM: Wyatt Berger Lead Planner PROJECT: TC-COM-0224-00312 1046 East Broadway Boulevard – C-3 Smoke shop (1st Review) TRANSMITTAL DATE: April 17, 2024 Please resubmit revised drawings with a detailed response letter stating how all Zoning Review Section comments were addressed. The site is in the C-3 zone (UDC 4.7.22). A smoke shop is a permitted use in the C-3 zone, subject to use-specific standard 4.9.9.H. 1. On November 14, 2023, the Mayor and Council approved an amendment to the Tucson Unified Development Code (UDC) to establish regulations for smoke shops. The regulations were effectuated on December 14, 2023. To be considered a legal nonconforming use, a smoke shop is required to be vested through either an approved Certificate of Occupancy for the use or an approved business license. Zoning staff has determined that an approved business license was not obtained for this use at this location prior to December 14, 2023. As such, demonstrate how the proposed use complies with use-specific standard 4.9.9.H with the resubmittal of TC-COM-0224-00312. If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951. |
