COMMENTS: Please submit development package. Also submit revised commercial building drawings and any corrected plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

The site is in the C-3 zone (UDC 4.7.22). A smoke shop is a permitted use in the C-3 zone, subject to use-specific standard 4.9.9.H. 1. On November 14, 2023, the Mayor and Council approved an amendment to the Tucson Unified Development Code (UDC) to establish regulations for smoke shops. The regulations were effectuated on December 14, 2023. To be considered a legal nonconforming use, a smoke shop is required to be vested through either an approved Certificate of Occupancy for the use or an approved business license.

1. (COMMENT) The submitted comment response letter indicated that the business license approved prior to the above date was attached. None was found in the attachment. Please resubmit business license.

2. (COMMENT) A development package will be necessary to submit and approve prior to the approval of these building plans.

The submitted plans show a drive-through window that was not part of the approved prior use of this building. Per UDC Section 3.3.3.G.2.c, a site plan is required when a reconfiguration of an area outside a building occurs. A new drive-through would meet this requirement.

The drive-through must meet the design requirements indicated in UDC Section 7.4.6. and any associated Technical Standards Manual requirements. Show the drive-through width and that it meets setback and vehicle stacking requirements. Show drive-through maneuverability on and off site.

This comment was reviewed and received concurrence from Wyatt Berger, the prior reviewer.

3. (COMMENT) On the site plan show the entire dimensioned parcel boundaries. Only part of the parcel is shown.

4. (COMMENT) Show widths for all access lanes and parking area access lanes meet requirements as articulated in UDC Section 7.4.6. The eastbound access lane in front of the building (under the concrete apron) does not appear to meet minimum width requirements.

5. (COMMENT) Show pedestrian circulation from the accessible parking space to building entrance in accordance with UDC Section 7.4.6. and UDC TSM Section 7.


6. (COMMENT) Show pedestrian circulation to the new dumpster location in accordance with UDC Section 7.4.6. and UDC TSM Section 7.

7. (COMMENT) Additional comments on the site may be forthcoming based upon the submission and review of the development package.
