COMMENTS: Please submit business license with date prior to December 15, 2023 demonstrating the smoke shop is eligible to be Also submit revised commercial building drawings and any corrected plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

The site is in the C-3 zone (UDC 4.7.22). A smoke shop is a permitted use in the C-3 zone, subject to use-specific standard 4.9.9.H. 1. On November 14, 2023, the Mayor and Council approved an amendment to the Tucson Unified Development Code (UDC) to establish regulations for smoke shops. The regulations were effectuated on December 14, 2023. To be considered a legal nonconforming use, a smoke shop is required to be vested through either an approved Certificate of Occupancy for the use or an approved business license.

1. (COMMENT) The submitted comment response letter indicated that the business license approved prior to the above date was attached.

The provided business license shows an effective date of January 1, 2024, which is after the December 14, 2023 on which the new UDC regulations regarding smoke shops came into effect.

If the client cannot show proof that they had an approved CofO or business license issued prior to this date, then we would treat the smoke shop as new and it would be required to meet all stipulations of UDC 4.9.9.H. In such a case, since the site is within the minimum 1,000 ft setback required from parks, schools, and childcare, as well as within the minimum half-mile setback from existing smoke shops, it would not receive zoning approval under UDC 4.9.9.H.

Please reference comment from Loran Shamis on the OK to Submit for TD-DEV-0225-00044 reiterating the above-noted CofO or business license requirement issued prior to the new smoke shop regulation. Future comments regarding this issue will be addressed on the development package permit; any new documents submitted in reference to the business license should be attached to the development package moving forward.

2. (COMMENT) A commercial building permit attached to a development package cannot receive final Site Zoning approval until the development package is issued. Final approval for this permit cannot occur until TD-DEV-0225-00044 is approved.

3. (COMMENT) Additional comments on the site may be forthcoming based upon the submission and review of the development package.
